“半年被‘試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)’了三(san)(san)次,不(bu)簽合同、不(bu)買(mai)保險、不(bu)發全薪……什么福利都沒有(you)。”廣東某職業學(xue)院應屆(jie)生齊同學(xue)初(chu)入職場,卻連(lian)連(lian)遇上不(bu)良企(qi)業,試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)成為“白用(yong)(yong)(yong)(yong)(yong)期(qi)”。 據廣州媒體報(bao)道,由于就(jiu)業形勢(shi)嚴峻(jun),“試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)合格(ge)方簽勞(lao)動(dong)合同”目(mu)前成為不(bu)少(shao)(shao)招聘企(qi)業的(de)(de)不(bu)成文規定(ding);至少(shao)(shao)三(san)(san)成找(zhao)工作的(de)(de)大(da)學(xue)生因求職心(xin)切(qie),遭(zao)受過用(yong)(yong)(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)的(de)(de)各種“剝削”。 當前,找(zhao)到(dao)工作的(de)(de)大(da)中專(zhuan)畢業生,相當一部分逐步進入試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)。試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi),是用(yong)(yong)(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)和勞(lao)動(dong)者相互(hu)了解、適應的(de)(de)一個時期(qi)。但是,少(shao)(shao)數用(yong)(yong)(yong)(yong)(yong)人(ren)單(dan)位(wei)(wei)卻利用(yong)(yong)(yong)(yong)(yong)勞(lao)動(dong)力市(shi)場供(gong)大(da)于求、大(da)中專(zhuan)畢業生求職心(xin)切(qie)的(de)(de)心(xin)理,屢屢設下試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)陷阱。對此,大(da)中專(zhuan)畢業生要擦亮眼睛(jing),警惕黑心(xin)的(de)(de)試(shi)(shi)(shi)用(yong)(yong)(yong)(yong)(yong)期(qi)陷阱,并依法維(wei)權。
陷阱一 口頭約定一“試”了之 剛剛從南京師范學院畢業的小韓,通過參加招聘會被一家廣告公司錄用。按照口頭約定,工作前3個月為試用期,公司要看他的表現來決定是否正式聘用他。 在單位,小韓踏踏實實工作,只要給了任務就能按時完成。3個月下來,小韓本以為自己可以輕松被該公司正式錄用。誰料試用期一結束,經理卻說他不稱職。事后小韓得知,與他同一批進公司的員工,沒一個通過試用期的“檢驗”。而后不久,該公司又新招了一批員工繼續“試用”。 小韓想和公司理論,可試用期的一切都是口頭約定的,由于沒有書面勞動合同的約束,又缺乏有力的證據,小韓根本無法維護自己的權益。
【深度剖析】 不少大學生找工作時經常遇到這種情況,在與用人單位簽訂勞動合同之前,總會有個試用期。但令他們不解的是,往往試用期馬上就要結束了,自己也被“炒”了。 我國《勞動合同法》第七條規定,用人單位自用工之日起即與勞動者建立勞動關系。第十條規定,建立勞動關系,應當訂立書面勞動合同。已建立勞動關系,未同時訂立書面勞動合同的,應當自用工之日起一個月內訂立書面勞動合同。從這些規定可以看出,不論勞動合同是無固定期限的、有固定期限的,還是以完成一定工作為期限的,用人單位都應當在員工開始為其工作時就與勞動者簽訂勞動合同。在簽訂正式勞動合同之后,雙方才可以約定試用期,而不是在試用期滿后再簽訂勞動合同。 也就是說,沒有正式合同便沒有試用期。相當一部分用人單位利用大學生勞動法律知識匱乏的弱點,以試用期為由,不與其簽訂勞動合同,以達到隨時解聘和在發生勞動爭議時使大學生“空口無憑”的目的。因此,用人單位的這種做法,明顯違反了《勞動合同法》的規定。 陷阱二 找借口試用期將滿被辭退 某地一家翻譯中心,因業務發展需要,聘用了5名大學畢業生做翻譯員。小王等5名大學生到公司報到的那天,老板承諾試用3個月,試用期月薪250元(低于當地最低工資標準),試用期滿正式錄用,月工資不少于3000元。 在就業形勢如此嚴峻的情況下,剛參加工作,試用期滿就能有這樣的薪水,小王等5名大學生非常滿意。 為了得到老板的肯定,能被正式錄用,他們加班加點不停地為公司賺錢。可是,在僅差10天就試用期滿的時候,老板突然以“不適宜在本公司工作”為由,將5人全部辭退。
【深度剖析】 小王等5名大學生的遭遇,并非個案。許多大學生都遇到過這樣的事。該翻譯中心的做法,起碼有兩條明顯違法。 一是試用期工資過低。《勞動合同法》第二十條規定,勞動者在試用期的工資不得低于本單位相同崗位最低檔工資或者勞動合同約定工資的百分之八十,并不得低于用人單位所在地的最低工資標準。 二是隨意辭退員工。《勞動合同法》第三十九條和第四十條,規定了勞動者在試用期間被證明不符合錄用條件等六種情形,以及勞動者患病或者非因工負傷,醫療期滿后,不能從事原工作也不能從事由用人單位另行安排的工作等三種情況。符合上述情況的,用人單位可以解除勞動合同,但是,應當提前三十日以書面形式通知勞動者本人。 而且,根據最高人民法院關于審理勞動爭議案件適用法律若干問題的解釋第13條的規定,用人單位負有“員工不符合錄用條件”的舉證責任,也就是適用法律上的舉證倒置原則。如果用人單位不能很好地證明,甚至根本沒有任何合理的理由,就不能將小王等5名大學生辭退。 陷阱三 試用期“沒完沒了” 學習市場營銷的大學畢業生小羅,說起她的遭遇時,顯得“很受傷”。因為,她的試用期總是“沒完沒了”。 今年初,她應聘到蘇州市內一家化妝品公司工作,試用期一干就是6個多月。小羅要求公司結束試用期,但公司有關人員卻表示,她雖然干了這么長時間,但銷售業績依然達不到公司的要求,因此還得“繼續試用”,直到公司認為合格才能轉正。 于是,小羅咬著牙繼續干,就這么又干了2個月,公司還是以銷售業績為由不給她轉正。無奈之下,小羅只能離開這家公司,另謀出路。
【深度剖析】 有些用人單位往往會說:“招聘者和應聘者之間是雙向選擇,只有通過試用期的考查,單位認為應聘者適合崗位需求后,才能簽訂正式的勞動合同,這很合情合理。” 但實際上,這是一個陷阱。因為,《勞動法》第二十一條規定:勞動合同可以約定試用期。試用期最長不得超過六個月。《勞動合同法》第十九條也規定:勞動合同期限三個月以上不滿一年的,試用期不得超過一個月;勞動合同期限一年以上不滿三年的,試用期不得超過二個月;三年以上固定期限和無固定期限的勞動合同,試用期不得超過六個月。同一用人單位與同一勞動者只能約定一次試用期。也就是說,試用期不能“沒完沒了”。 陷阱四 試用期內不享受工傷保險 畢業生小王應聘到某化工機械廠,簽訂了為期1年的勞動合同,合同約定試用期為一個月。 哪知“天有不測風云”,上班第8天,小王就因機械發生故障,手臂受傷了。小王因此住院治療一個月,在住院治療期間小王父母曾向廠方提出工傷待遇申請。但傷愈后,當小王找企業報銷醫療費時,該廠不僅不按工傷支付全部醫療費用,還以誤工為由只發給他基本生活費。其說法是小王試用期未滿,不是企業正式職工,不能享受工傷保險待遇。
【深度(du)剖(pou)析】 據(ju)(ju)了(le)(le)解,目前,有(you)(you)(you)少(shao)部分(fen)用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位以(yi)試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)是(shi)(shi)(shi)(shi)(shi)考(kao)查期(qi)或者試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)內(nei)(nei)沒(mei)有(you)(you)(you)正(zheng)式建立勞(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi)為(wei)(wei)由,在試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)內(nei)(nei)不(bu)(bu)給畢業(ye)(ye)生繳納(na)社會(hui)保險(xian)費(如(ru)養老、失業(ye)(ye)、醫療、工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)保險(xian)等(deng))。 《勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)法(fa)(fa)》第十九條(tiao)規定:試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)包含(han)在勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)期(qi)限內(nei)(nei)。按(an)照該(gai)法(fa)(fa),盡管小(xiao)王(wang)(wang)試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)未滿(man),但自小(xiao)王(wang)(wang)與(yu)(yu)(yu)該(gai)化工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)機械廠(chang)簽訂勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)之日(ri)起(qi),勞(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi)便已確立,成為(wei)(wei)該(gai)廠(chang)的(de)(de)(de)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)。因此,小(xiao)王(wang)(wang)在試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)內(nei)(nei)所享有(you)(you)(you)的(de)(de)(de)權(quan)利義務與(yu)(yu)(yu)試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)滿(man)后(hou)享有(you)(you)(you)的(de)(de)(de)權(quan)利義務是(shi)(shi)(shi)(shi)(shi)一(yi)致的(de)(de)(de)。 我國(guo)《工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)保險(xian)條(tiao)例》也規定,依法(fa)(fa)享受(shou)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)保險(xian)待(dai)遇(yu)的(de)(de)(de)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)范疇是(shi)(shi)(shi)(shi)(shi)所有(you)(you)(you)與(yu)(yu)(yu)用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位存(cun)在勞(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi)的(de)(de)(de)各種(zhong)(zhong)用(yong)(yong)(yong)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)形式、各種(zhong)(zhong)用(yong)(yong)(yong)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)期(qi)限的(de)(de)(de)勞(lao)(lao)動(dong)(dong)(dong)者。因此,即使在試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)內(nei)(nei),員工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)出現(xian)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)傷(shang),同(tong)樣(yang)享受(shou)國(guo)家規定的(de)(de)(de)各種(zhong)(zhong)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)保險(xian)待(dai)遇(yu)。 為(wei)(wei)了(le)(le)防止掉入(ru)種(zhong)(zhong)種(zhong)(zhong)試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)的(de)(de)(de)陷(xian)阱,業(ye)(ye)內(nei)(nei)有(you)(you)(you)關(guan)專家給了(le)(le)求職(zhi)大學生們四(si)(si)條(tiao)建議: 一(yi)是(shi)(shi)(shi)(shi)(shi)進入(ru)用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位后(hou),必須(xu)及時要(yao)(yao)(yao)求和單(dan)(dan)(dan)(dan)(dan)位簽訂勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong);二是(shi)(shi)(shi)(shi)(shi)試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)間要(yao)(yao)(yao)注意(yi)保留相關(guan)證據(ju)(ju),如(ru)試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)間的(de)(de)(de)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)、工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資單(dan)(dan)(dan)(dan)(dan)、考(kao)勤表(biao)等(deng),凡(fan)是(shi)(shi)(shi)(shi)(shi)能夠證明自己與(yu)(yu)(yu)單(dan)(dan)(dan)(dan)(dan)位存(cun)在勞(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi)、工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作起(qi)始(shi)日(ri)期(qi)、工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作內(nei)(nei)容(rong)等(deng)的(de)(de)(de)證據(ju)(ju),都要(yao)(yao)(yao)保存(cun)好;三是(shi)(shi)(shi)(shi)(shi)求職(zhi)時要(yao)(yao)(yao)先了(le)(le)解用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)(dan)位是(shi)(shi)(shi)(shi)(shi)否(fou)真(zhen)有(you)(you)(you)用(yong)(yong)(yong)人(ren)(ren)意(yi)向(xiang),不(bu)(bu)要(yao)(yao)(yao)被那(nei)些常(chang)年招人(ren)(ren)、常(chang)年換人(ren)(ren)的(de)(de)(de)不(bu)(bu)法(fa)(fa)單(dan)(dan)(dan)(dan)(dan)位所蒙騙;四(si)(si)是(shi)(shi)(shi)(shi)(shi)一(yi)旦發現(xian)權(quan)益(yi)受(shou)到(dao)侵(qin)害,如(ru)不(bu)(bu)付報(bao)酬、薪(xin)金過低、工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)拒賠、違(wei)規延長試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)等(deng),要(yao)(yao)(yao)及時向(xiang)勞(lao)(lao)動(dong)(dong)(dong)監察部門(men)舉報(bao)或提起(qi)仲裁和訴訟(song),以(yi)便維護(hu)自己的(de)(de)(de)合(he)(he)法(fa)(fa)權(quan)益(yi)。
